This Website is owned and operated by eHealthSpace.org Limited ACN 140 628 922. ("we", "our" or "us"). "You" or "your" means a user of the Website. These Website terms (Terms) govern your rights, responsibilities and obligations as a user of [eHealthspace.com.au] (Website).

By accessing the Website you agree to be bound by the Terms and you consent to our disclosure and use of any personal information you submit to the Website, provided that the disclosure and use is always in accordance with our privacy policy.

Before using the Website please review the Terms carefully and do not use or continue to use the Website if you do not agree with them.

2. Intellectual Property

You acknowledge and agree that, as between you and us, we are the owner of the intellectual property rights in the Website and the trademark "eHealthSpace" and that those intellectual property rights remain the sole and exclusive property of eHealthspace Limited and our licensors at all times. We may, from time to time, include on the Website links to other Internet sites. These links are provided for convenience only and do not constitute an endorsement of information of those sites.

5. Modifications to the Terms

We may, at our sole discretion, modify these Terms, at any time. Changes will be posted on the Website. Continued use of the Website following posted notices of changes (notice is given by changing the date of last revision), means that you have accepted and are bound by the changes.

6. Information provided by you

The Website contains advertisements and promotions of various organisations. These organisations are separate to eHealthSpace Limited. We do not endorse or guarantee the products or services promoted. The organisations who provide advertising or promotional materials to us retain ownership of all rights in their own trademarks and product information.

The Website may also contain information or material which is posted by you or other Website users (User Provided Content). For all User Provided Content, we are a distributor only and we are not responsible for the accuracy or completeness of this information.

If you submit User Provided Content to the Website:

• You grant us a licence to use, host and distribute the User Provided Content on the Website.

• You acknowledge that it may be seen and used by users under the licence described in these terms. • We may send you correspondence related to that User Provided Content.

• You must only submit User Provided Content which belongs to you or for which you have authorization to submit from the owner of that content.

• You must not contribute the personal information of another person without their express permission and you must not contribute content that may violate the privacy, property or other rights of other people or organisations.

• You must not contribute (and we may remove in our sole discretion) any User Provided Content that is in our opinion fraudulent, abusive, illegal, obscene, indecent, defamatory, incites racial or ethnic hatred or violates the rights of others or is in any other way objectionable.

• If you lodge an advertisement or promotion on the Website you must ensure that all content provided by you complies with all relevant laws and is not misleading and deceptive, defamatory or offensive.

7. Private Forums

On the Website there are various restricted access areas (Private Forums) which contain content that may be relevant for particular members of the relevant organisation or association administering the Private Forums. We do not endorse any of these organisations or industry associations. This clause 7 applies to administrators and users of those Private Forums.

  • Forum Registration and Security

The use of the Private Forums by an administrator is subject to the Private Forums Agreement between us and the relevant administrator.

Private Forums administrator may grant to its members access to the relevant Private Forums by the use of usernames and passwords. We or the Private Forums administrator may de-activate the Private Forums at any time and terminate your access to the Private Forums.

  • Forum Username and Passwords

You are responsible for (i) maintaining the confidentiality and security of your username and password; and (ii) all unauthorised usage or activity that occurs on your account. You must promptly notify us if there is any unauthorised usage of your username or password.

Rights to administer or access a Private Forum is non-transferable.

You may update, edit or terminate your account at any time. You must maintain and update the information as supplied by you to ensure accuracy at all times.

  • Forum Responsible Usage

You are responsible for all usage or activity on the Website via your password account. Distribution of your username or password to others for access to the Website is expressly prohibited and is a breach of these Website Terms.

  • Communications

We may send electronic mail to you, for the purpose of informing you of changes or additions to the Website.

8. Termination

We reserve the right discontinue the operation of, or suspend access to, the Website. Additionally, should you breach these Website Terms we may restrict your ability to access a Private Forums or the Website and suspend your account.

9. Applicable Law

These terms are governed by and must be construed in accordance with the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and all courts which have jurisdiction to hear appeals from those courts.
